It is the intent of the Board of Directors of the Anacortes School District that all students, parents, and school employees who deal directly with students have access to and an understanding of the state laws, regulations, and district policies that pertain to the procedural and substantive rights of students, teachers, and administrators. School Districts are required by federal and state laws and regulations to provide annual notices to parents and guardians, as well as students and employees in some cases. These required notifications cover topics ranging from access to student records to staff qualifications and pesticide applications.
Eligibility for Free and Reduced-Price Meals
Parents and guardians of students may apply for free or reduced-price meals through an application form available at the beginning of each school year. This application is used to determine eligibility based on household income and other factors as outlined in the USDA’s guidelines.
Confidentiality of Eligibility Status
Eligibility for free or reduced-price meals is confidential, and the Anacortes School District will not disclose students' eligibility status except as permitted under the National School Lunch Act. Requests for such information will only be honored if the requestor falls within the categories specified by law.
Alternative Provisions for Meal Eligibility
In line with federal legislation, certain students may receive eligibility for free meals for a 2-year period, which may simplify the application process. Additionally, some schools in the district, where more than 80% of students qualify for free or reduced-price meals, are able to provide certification every two years instead of annually.
Local School Wellness Policies
The Anacortes School District is committed to promoting a healthy school environment through its Local School Wellness Policy. This policy is periodically reviewed and updated to ensure it aligns with federal standards and to assess the district’s progress in meeting wellness goals. The district will provide annual updates to the public about the policy’s content and any progress made, as well as make available the results of the triennial assessment.

Anacortes School Board Policy 6700- Nutrition, Health, and Physical Education
ASD is in compliance with federal and state laws, including the National School Lunch Act (42 U.S.C. § 1758) and the Healthy, Hunger-Free Kids Act of 2010. Additionally, Washington State law mandates that school districts participating in these child nutrition programs provide annual notifications regarding the availability of free and reduced-price meals, as well as the application process. Washington State Administrative Code (WAC) 392-172A-02025 also requires districts to share information on meal eligibility and local wellness policies to ensure transparency and access for all families on an annual basis.

In compliance with various Federal and State Laws, the following School Districts require their faculty, administration, and staff to comply with applicable State and Federal Laws that prohibit discrimination, including, but not limited to:
1. RCW Chapter 49.60, State of Washington, Law Against Discrimination and RCW Chapter 28A.642 prohibit discrimination on the basis of race, creed, color, national origin, citizenship or immigration status, sex, honorably discharged veteran or military status, sexual orientation including gender expression or identity, or the presence of any sensory, mental, or physical disability or the use of a trained dog guide or service animal by a person with a disability and provides equal access to the Boy Scouts and other designated youth groups.
2. Title VI of the Civil Rights Act of 1964 requires there be no discrimination on the basis of race, color, or national origin in the operation of any federally assisted program.
3. Title VII of the Civil Rights Act of 1964, as amended by the Equal Employment Opportunity Act of 1972, prohibits discrimination in employment on the basis of race, color, sex, religion, or national origin.
4. Title IX of the Educational Amendments of 1972 and RCW 28A.85 prohibits discrimination on the basis of sex, including sex-based harassment, in any educational program or activity receiving federal financial assistance, including admission and treatment of students and employment.
5. In terms of Section 504 of Public Law 93-112, the above recipients do not discriminate on the basis of disability in admission or access to, or treatment of employment in its programs and activities.
6. Child Find. The districts have developed and implemented awareness and screening activities for the purpose of locating, identifying, and evaluating resident students who are suspected of having disabilities and are in need of receiving special education and related services or are eligible for Section 504. These procedures shall encompass students ages birth through twenty-one regardless of the severity of their disability who reside in the districts, including those attending public and private agencies and institutions, and religious schools.
The districts’ procedures shall also include methods for conducting child find activities including methods to determine which students are not currently receiving needed special education and related services or are eligible for Section 504. The procedures shall include methods to locate students who are highly mobile and students suspected of being a student with a disability and in need of services even though they are advancing from grade to grade. Child Find procedures shall be developed in consultation with appropriate representatives of private school students.
7. In accordance with Americans with Disabilities Act (ADA) adopted July 26, 1990, and as amended, the above school districts prohibit discrimination against qualified individuals with disabilities in all aspects of employment and public access to facilities and educational programming.

The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. To help ensure student safety and citizenship in online activities, all students will be educated about appropriate online behavior, including interacting with other individuals on social networking websites and in chatrooms and cyberbullying awareness and response.
Anacortes students may have supervised access to the internet while at school. Use of the internet by students and staff of Anacortes School District shall be in support of education and research that is consistent with the District’s School Improvement Plans. In order for students to have access to the internet while at school, it is necessary for students to complete the Student User Internet Access Release Form and return it to their classroom teacher. Access to the internet may be revoked by a teacher or the principal if a student violates the standards of use described in the form.

ASD is required to provide annual notice of its Prohibition Against Sexual Harassment Policy.
Washington law requires state and local agencies to make public records available to the public. This law, the Washington State Public Records Act RCW 42.56, supports the public's right to be informed about what their government is doing.
The Act also lists certain public records that do not have to be disclosed. These exemptions are intended to prevent unreasonable invasions of personal privacy or the use of public records for personal or commercial gain.
The Act also requires that the public records requested are "identifiable." Your public disclosure request must include a reasonable description that would allow an Anacortes School District employee to locate the records. A general question is not a public disclosure request.

Retention Notification
Pursuant to WAC 392-172A-05235 and the Office of the Secretary of State for Washington State, the Anacortes School District retains special education records, including IEPs, evaluations, and 504 plans, for six years from separation of services. If a student has not received special education or 504 services from ASD in more than six years, the records are no longer available.

The Protection of Pupil Rights Amendment affords parents/guardians certain rights regarding the District’s use of surveys, collection, and use of information for marketing purposes, and certain physical exams. These include the right to:
These rights generally transfer to an adult student when they turn 18 years old or become an emancipated minor under Washington law.
The District will develop and adopt policies, in consultation with parents/guardians, regarding these rights, as well as make arrangements to protect student privacy in the administration of protected information surveys and the collection, disclosure, or use of personal information for marketing, sales, or other distribution purposes. The District will directly notify parents/guardians of these policies at least annually at the start of each school year and after any substantive changes. The District will also directly notify, such as through U.S. Mail or email, parents/guardians of students who are scheduled to participate in the specific activities or surveys noted below and will provide an opportunity for the parent to opt their student out of participation of the specific activity or survey. The District will make this notification to parents/guardians at the beginning of the school year if the District has identified the specific or approximate dates of the activities or surveys at that time. For surveys and activities scheduled after the school year starts, parents/guardians will be provided reasonable notification of the planned activities and surveys listed below and be provided an opportunity to opt their student out of such activities and surveys.
